Welcome to Plantshi Care! These Terms and Conditions ("Terms") govern your access to and use of the Plantshi Care website (www.plantshicare.com) and all services provided by Plantshi Care (collectively, the "Services"). Please read these Terms carefully before using our Services. By accessing or using any part of our Services, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.
These Terms constitute a legally binding agreement between you and Plantshi Care. We reserve the right to update, change, or replace any part of these Terms by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
1. Acceptance of Terms
By accessing and using the Plantshi Care website and Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, our Privacy Policy, Cookie Policy, and Disclaimer. If you do not agree to these Terms, you must not use our Services. These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
Your agreement to these Terms is a condition precedent to your use of the Services. We may modify these Terms at any time, and such modifications will be effective immediately upon posting the updated Terms on our website. Your continued use of the Services after any such modifications indicates your acceptance of the revised Terms. We encourage you to review these Terms regularly to stay informed of any updates.
2. Services Provided
Plantshi Care specializes in providing comprehensive gardening support, care plans, and personalized plant care routines for residential and small commercial spaces. Our Services include, but are not limited to:
- Plant Care & Revival: Monthly plant health checks, diagnosis and treatment of yellowing, wilting, and pest infestations, fertilizer application, and repotting services. This also includes disease prevention, leaf cleaning, seasonal nutrient boosts, humidity control recommendations, and light optimization guidance.
- Garden Maintenance Plans: Weekly or monthly maintenance for balconies, terraces, and small landscapes, including pruning, trimming, soil top-up, weed removal, and composting. Additional services may include seasonal planting, irrigation system checks, edging, mulching, patio clearing, and integrated pest management.
- Indoor Plant Setup & Styling: Placement planning based on sunlight zones, pot and decor pairing, air-purifying plant bundles, custom planter design and installation, living wall consultation, plant sourcing, biophilic design integration, and maintenance education for new setups.
- Smart Watering & Monitoring: Installation of drip systems for balconies, app-based moisture alerts (optional), seasonal watering schedules, soil moisture sensor installation, automated irrigation system setup, water quality testing, rain sensor integration, and remote monitoring.
- Consultations: Including video call plant consultations and WhatsApp support for quick queries and advice.
- Plantshi Care Journal: Providing a digital or physical journal for tracking plant history and progress.
The specific scope of services for each client will be detailed in a separate service agreement or booking confirmation, which will form an integral part of these Terms. We reserve the right to refuse service to anyone for any reason at any time.
3. User Responsibilities
As a user of Plantshi Care Services, you agree to:
- Provide Accurate Information: Ensure that all information provided to Plantshi Care, including personal details, address, payment information, and details about your plants or garden, is accurate, complete, and up-to-date. You are responsible for any consequences arising from inaccurate or incomplete information.
- Ensure Access: Provide our team with safe and unobstructed access to your property and the plants/gardens requiring service during scheduled appointment times. This includes ensuring pets are secured and any hazards are communicated beforehand.
- Communicate Clearly: Clearly communicate your specific needs, concerns, and any changes to your plants or property that may affect the provision of services.
- Adhere to Payment Terms: Make timely payments for all services rendered as per the agreed-upon pricing and payment schedule. Failure to do so may result in suspension or termination of services.
- Comply with Laws: Use our Services in compliance with all applicable local, state, national, and international laws and regulations.
- Maintain Safety: Ensure a safe working environment for our staff on your property. This includes informing us of any dangerous conditions, hazardous materials, or aggressive animals.
- Review Service Confirmations: Carefully review all service confirmations, invoices, and communications from Plantshi Care to ensure accuracy.
- Protect Account Credentials: Keep your account login details confidential and secure. You are responsible for all activities that occur under your account.
- Proper Use of Information: Use any information, advice, or materials provided by Plantshi Care solely for your personal or internal business use related to your plants and garden, and not for commercial redistribution without our express written consent.
- No Misuse: Not to misuse the website or services by knowingly introducing viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful.
- Respect Intellectual Property: Not to infringe upon the intellectual property rights of Plantshi Care or any third party.
- Feedback: Provide constructive feedback to help us improve our services.
Failure to adhere to these responsibilities may result in the suspension or termination of your services without refund, at the sole discretion of Plantshi Care.
4. Booking, Cancellations, and Rescheduling
Booking: All service bookings must be made through our official channels (website, phone, or designated booking platform). Upon booking, you will receive a confirmation detailing the service, date, time, and estimated cost. This confirmation constitutes a binding agreement for the provision of services.
Cancellations:
- Standard Services: For one-time services or individual appointments, cancellations must be made at least 24 hours prior to the scheduled service time to avoid a cancellation fee. Cancellations made less than 24 hours in advance may incur a fee equivalent to 50% of the service cost.
- Subscription Plans: For monthly or recurring maintenance plans, a minimum of 7 days' notice is required for cancellation of the entire plan. Individual appointments within a plan require 24 hours' notice for rescheduling or cancellation to avoid a service charge for that specific visit.
- Emergency Cancellations: In cases of genuine emergencies (e.g., medical emergency, natural disaster), please contact us as soon as possible. We will review such cases on an individual basis.
Rescheduling:
- Standard Services: Appointments can be rescheduled free of charge if a request is made at least 24 hours before the scheduled service time. Rescheduling requests made with less than 24 hours' notice may be subject to a rescheduling fee.
- Subscription Plans: Individual appointments within a subscription plan can be rescheduled free of charge with at least 24 hours' notice.
- Our Discretion: Plantshi Care reserves the right to reschedule or cancel appointments due to unforeseen circumstances, including but not limited to, adverse weather conditions, staff illness, or operational difficulties. In such cases, we will endeavor to provide as much notice as possible and work with you to find a suitable alternative time.
No-Shows: If our team arrives at your property for a scheduled service and is unable to gain access or if the client is a no-show without prior notification, the full service fee may be charged. It is your responsibility to ensure access is available at the scheduled time.
All cancellation and rescheduling requests must be communicated via phone or email to our customer service team. The time of receipt of your communication will be considered the official time of your request.
5. Payment Terms
Pricing: All prices for services are quoted in Indian Rupees (INR) unless otherwise specified. Prices are subject to change without prior notice, but any changes will not affect confirmed bookings. Custom quotes for specific projects will be valid for a period of 30 days from the date of issuance.
Invoicing: For one-time services, full payment is typically due upon completion of the service. For subscription plans, payment will be billed on a recurring basis (e.g., monthly) as agreed upon at the time of subscription. Invoices will be sent to your registered email address.
Payment Methods: We accept various payment methods, including credit/debit cards, net banking, and UPI, processed securely through our third-party payment gateways. By providing your payment information, you authorize us to charge the applicable fees to your chosen payment method.
Late Payments: Invoices that remain unpaid beyond their due date may be subject to a late payment fee of 2% per month or the maximum amount permitted by law, whichever is lower, calculated from the due date until the date of full payment. Plantshi Care reserves the right to suspend or terminate services for overdue accounts without prior notice.
Refunds: All service fees are non-refundable once the service has been completed, unless otherwise explicitly stated in a separate written agreement or required by applicable consumer protection laws. If you are dissatisfied with a service, please contact us within 24 hours of service completion to discuss your concerns. We will review each case on its merits and may offer a partial refund, re-service, or credit at our sole discretion.
Taxes: All prices quoted are exclusive of applicable taxes, unless otherwise stated. Taxes will be added to your invoice as required by law.
Disputes: If you dispute any charges, you must notify Plantshi Care in writing within 7 days of the invoice date, providing detailed reasons for the dispute. Failure to do so will constitute your acceptance of the charges.
6. Intellectual Property Rights
All content on the Plantshi Care website, including but not limited to text, graphics, logos, images, audio clips, video clips, software, and the compilation thereof, is the property of Plantshi Care or its content suppliers and is protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. The "Plantshi Care" name and logo are trademarks of Plantshi Care. You may not use these trademarks without our prior written permission.
You may access, view, and print content from the website for your personal, non-commercial use only. Any other use, including the reproduction, modification, distribution, transmission, republication, display, or performance of the content on this site, is strictly prohibited without the express prior written consent of Plantshi Care.
If you submit any content to us (e.g., testimonials, feedback, photos of your garden for our portfolio), you grant Plantshi Care a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media, provided such use is in accordance with our Privacy Policy.
Plantshi Care respects the intellectual property of others. If you believe that your intellectual property rights have been infringed, please contact us with details of the alleged infringement.
7. User Generated Content
Our Services may allow you to submit, upload, publish, or otherwise make available content, including but not limited to text, photographs, and videos ("User Content"). You retain all rights in, and are solely responsible for, the User Content you make available through the Services.
By making any User Content available through the Services, you grant to Plantshi Care a worldwide, non-exclusive, transferable, sublicensable, royalty-free, perpetual, irrevocable license to use, copy, modify, create derivative works based upon, distribute, publicly display, publicly perform, and otherwise exploit your User Content in connection with the Services and Plantshi Care’s (and its successors’ and affiliates’) business, including without limitation for promoting and redistributing part or all of the Services (and derivative works thereof) in any media formats and through any media channels. This license includes the right to use your name, likeness, and voice, if applicable, for marketing and promotional purposes.
You represent and warrant that: (i) you are the sole and exclusive owner of all User Content that you make available through the Services or you have all rights, licenses, consents and releases that are necessary to grant to Plantshi Care the rights in such User Content, as contemplated under these Terms; and (ii) neither the User Content nor your posting, uploading, publication, submission or transmittal of the User Content or Plantshi Care’s use of the User Content (or any portion thereof) will infringe, misappropriate or violate a third party’s patent, copyright, trademark, trade secret, moral rights or other proprietary or intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.
You agree not to provide User Content that is defamatory, libelous, hateful, violent, obscene, pornographic, unlawful, or otherwise offensive, as determined by Plantshi Care in its sole discretion, whether or not such material may be protected by law. Plantshi Care may, but is not obligated to, review, monitor, or remove User Content, at Plantshi Care’s sole discretion and at any time and for any reason, without notice to you.
8. Disclaimers and Limitation of Liability
Disclaimer of Warranties: The Services are provided on an "as is" and "as available" basis. Plantshi Care makes no representations or warranties of any kind, express or implied, as to the operation of their Services or the information, content, materials, or products included on the Services. You expressly agree that your use of the Services is at your sole risk. To the full extent permissible by applicable law, Plantshi Care disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.
Plantshi Care does not warrant that the Services, its servers, or e-mail sent from Plantshi Care are free of viruses or other harmful components. Plantshi Care will not be liable for any damages of any kind arising from the use of the Services, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
Limitation of Liability: In no event shall Plantshi Care, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
Plantshi Care's total liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Plantshi Care for the Services during the three (3) month period prior to any cause of action arising.
Plant Health Disclaimer: While Plantshi Care employs highly skilled professionals and uses best practices, the health and growth of plants are subject to numerous variables beyond our control, including but not limited to environmental conditions (light, temperature, humidity), genetic predispositions, pre-existing conditions, client care between visits, and unforeseen pests or diseases. Therefore, Plantshi Care cannot guarantee the survival, flourishing, or specific growth outcomes of any plant. Our services are provided with the aim of promoting plant health and aesthetics based on the information available and conditions observed at the time of service.
Property Access Disclaimer: You are responsible for ensuring safe and clear access to the service areas. Plantshi Care is not liable for any damage to property or injury to persons resulting from unsafe access conditions or undisclosed hazards on your property.
9. Indemnification
You agree to defend, indemnify, and hold harmless Plantshi Care, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Services.
10. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended, for the time being in force, which rules are deemed to be incorporated by reference in this clause.
The seat of the arbitration shall be Delhi, India. The language of the arbitration shall be English. The decision of the arbitrator(s) shall be final and binding on both parties. Subject to the arbitration clause, you agree to submit to the exclusive jurisdiction of the courts located in Delhi, India, for the resolution of any disputes.
11. Termination
We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us to request account deletion.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
12. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect. The invalid or unenforceable provision will be replaced by a valid and enforceable provision that most closely matches the intent of the original provision.
13. Entire Agreement
These Terms and Conditions, together with the Privacy Policy, Cookie Policy, Disclaimer, and any service agreements or booking confirmations, constitute the entire agreement between you and Plantshi Care regarding your use of the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.
14. Force Majeure
Plantshi Care shall not be liable for any failure or delay in performance under these Terms due to causes beyond its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

These Terms do not create any agency, partnership, joint venture, or employment relationship between you and Plantshi Care. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms are for the benefit of, and will be enforceable by, the parties only. These Terms are not intended to confer any right or benefit on any third party.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
The headings in these Terms are for convenience only and shall not affect their interpretation.
Any notices or other communications provided by Plantshi Care under these Terms, including those regarding modifications to these Terms, will be given: (i) via email; or (ii) by posting to the Services. For notices made by email, the date of receipt will be deemed the date on which such notice is transmitted.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
